Maxkgo BMS User Agreement
Thank you for using the products and services provided by Dongguan Daqianjin Technology Co., Ltd! This agreement is a legal agreement between you (or the "User") and Maxkgo BMS (including the "Maxkgo BMS" App, hereinafter referred to as "Maxkgo BMS" or "us") regarding the various products and services provided by Maxkgo BMS. Maxkgo BMS hereby reminds you that if you wish to use Maxkgo BMS products, you must carefully read all the terms and conditions in this service agreement in advance. This agreement is binding on both parties.
Please read the following agreement carefully before use. This agreement helps you understand the services we provide to you and your rights and obligations. Your use and other actions will be deemed as your full understanding of all the terms of this agreement, agreement to enter into this agreement with Maxkgo BMS, and acceptance of the terms of this agreement. If you do not agree with the terms of this agreement or have doubts about the terms of this agreement, please do not use Maxkgo BMS services.

Article 1 Service Content
1.1 Maxkgo BMS provides users with relevant products, programs, and services in accordance with the laws of the People's Republic of China.
1.2 Maxkgo BMS enables seamless integration between the APP and BMS battery management system through efficient Bluetooth connection technology. This process not only ensures fast message delivery and accurate reception, but also enables real-time and detailed display of every important information returned by the system on the mobile interface.
1.3 The ownership of all Maxkgo BMS products involved in the Maxkgo BMS program and the intellectual property rights of related software belong to Dongguan Daqianjin Technology Co., Ltd.
1.4. Unless otherwise specified in this Agreement, Maxkgo BMS shall not be liable for any network services, i.e. the user assumes the risk of using the network services. Maxkgo BMS does not guarantee that the service will definitely meet the user's usage requirements, nor does it guarantee that the service will not be interrupted. We do not assume responsibility for the inability to remotely control home appliances due to server interruptions. We do not guarantee the timeliness, security, or accuracy of the service.
Article 2 User Instructions
2.1 Maxkgo BMS reminds you that your use of this product must be legal, and your use of the Internet must comply with relevant national policies and laws, such as criminal law, national security law, confidentiality law, computer information system security protection regulations, etc. You are fully responsible for all responsibilities arising from illegal use of the Internet.
2.2. The user understands and accepts the services provided by Maxkgo BMS. If, with their own permission, the user allows others to connect and control their own battery equipment, resulting in adverse consequences, Maxkgo BMS shall not be held responsible. MaxkgO BMS shall not be held responsible for any adverse consequences caused by its own connection to other people's products.
2.3. You shall not use Maxkgo BMS products to send or disseminate any information that obstructs social order or contains illegal, false, harassing, insulting, intimidating, harmful, destructive, provocative, obscene or pornographic content.
2.4. The user shall be responsible for all their actions, and Maxkgo BMS shall not be liable for any loss or damage caused to the user or any other third party as a result of the user's actions.
2.5. In order to improve and enhance the user experience of various services provided by Maxkgo BMS, you agree that Maxkgo BMS may modify, copy, disseminate, or use any text, images, or other information materials of the "Maxkgo BMS" App that you upload, post, or use through this service, free of charge, regardless of whether the aforementioned actions are used for commercial or non-commercial purposes.
2.6. You confirm that before you start using Maxkgo BMS services, you should have the civil capacity required by the laws of the People's Republic of China that is appropriate for your actions. If you do not have the civil capacity corresponding to your actions as mentioned above, you and your guardian shall bear all consequences arising therefrom in accordance with the law. Specifically, if you are a minor, please use Maxkgo BMS services with the consent and guidance of your guardian.
2.7. You must maintain an objective and impartial attitude towards the activities and content published in our company, and shall not publish content that damages the image of Maxkgo BMS or violates the spirit of relevant activities.
2.8. You are not allowed to use our company's related products, programs, and services for illegal activities, endangering national security, leaking state secrets, or infringing on the legitimate rights and interests of others. You are also not allowed to use our company's related products, programs, and services to produce or engage in the following behaviors:
1) Publish, repost, and disseminate illegal speech containing insults, curses, defamation, attacks, defamation, infringement of Maxkgo BMS and/or third-party rights, or containing feudal superstitions, obscenity, pornography, obscenity, terror, violence, murder, gambling, reactionary, inciting ethnic hatred, endangering national unity, subverting state power, and other offensive and disgusting content, or set up internet names or service character names containing the above content;
2) Upload, post, send emails, or otherwise transmit content that infringes on anyone's patents, trademarks, copyrights, trade secrets, or other exclusive rights.
3) Impersonate Maxkgo BMS or network service administrator to post any fraudulent or false information;
4) Violating the privacy, portrait rights, copyright, trademark rights, contractual rights, or any other legal rights of any individual or entity;
5) Interfere with or disrupt this service or the servers and networks connected to this service, or fail to comply with the provisions of this service agreement.
6) Intentionally or unintentionally violating any relevant Chinese laws, regulations, rules, ordinances, or other legally binding norms.
7) Tracking or harassing others in other ways.
8) Other behaviors deemed inappropriate by Maxkgo BMS.
Article 3: User Privacy Protection
3.1 When Maxkgo BMS requires you to provide information related to your personal identity, it will disclose its privacy protection policy and personal information utilization policy to you in a clear and visible manner in advance.
3.2. To protect the security of your personal information, Maxkgo BMS uses various security technologies and procedures to safeguard your personal information from unauthorized access, use, or disclosure. You understand and agree with this.
3.3 Maxkgo BMS respects the privacy rights of users and will not disclose, edit or reveal their personal information or non-public content stored in Maxkgo BMS without the authorization of legitimate users, unless:
1) Obtain your consent.
2) Disclosures made to facilitate the resolution of any rights disputes between you and any third party.
3) According to relevant legal provisions or requirements of administrative or judicial institutions, disclose to third parties or administrative or judicial institutions.
4) If you violate relevant Chinese laws or website policies, you need to disclose them to third parties.
5) To provide the products or services you request, it is necessary to share your personal information with third parties.
6) To safeguard the legitimate rights and interests of Maxkgo BMS.
7) Other situations that require publicizing, editing, or disclosure of personal information.
3.4. You acknowledge and agree that Maxkgo BMS may work with partners to provide you with relevant services. In this case, if the partner is willing to assume the same responsibility as Maxkgo BMS to protect user privacy, Maxkgo BMS has the right to provide your information and other information to the partner in order to better serve you. In addition, MaxkgO BMS has the right to analyze the entire user database and commercially use the data without disclosing user privacy information.
Article 4 Intellectual Property and Confidentiality
4.1. Unless otherwise agreed by both parties, all intellectual property rights owned or existing by both parties prior to the signing of this agreement shall still belong to the original rights holders, and the signing or performance of this agreement shall not unconditionally grant the other party any intellectual property rights (including but not limited to copyrights, trademarks, trade secrets, proprietary technology, etc.) previously owned by the other party.
4.2. You must keep confidential the information and data that you have access to and have not disclosed to any third party, and shall not disclose it to anyone else. At the same time, without the written consent of Maxkgo BMS, relevant information and data shall not be disclosed to any third party.
Article 5 Service Change, Suspension and Termination
5.1 Maxkgo BMS has the autonomous right to optimize and modify the terms of this agreement in a timely manner, without violating the law, in order to continuously improve service quality. However, such modifications will not maliciously increase your liability or limit your legitimate rights. Once the terms of this agreement are changed, we will notify you via SMS or on all Maxkgo BMS websites or through mobile devices, so that you can understand the information we collect and how we use it. This type of privacy policy change will apply from the effective date specified in the notice or website regulations. We suggest that you regularly check this webpage for the latest information on our privacy practices. Your continued use of the product and services on the website, mobile phone, and/or any other device will be considered acceptance of the updated privacy policy. When we collect more personal information from you or when we wish to use or disclose your personal information for new purposes, we will seek your consent again.
5.2. If you have posted illegal information, seriously violated social ethics, or engaged in other behaviors that violate legal prohibitions, Maxkgo BMS has the right to immediately terminate the services provided to you.
5.3. If you engage in any improper behavior that violates the agreement or relevant regulations while receiving Maxkgo BMS services, Maxkgo BMS has the right to terminate the services provided to you.
5.4. Maxkgo BMS has the right to suspend all or part of the services provided to you when you violate this agreement or relevant regulations; Maxkgo BMS will notify you in an appropriate manner and inform you of the suspension period. The suspension period is reasonable, and Maxkgo BMS should promptly resume service to you upon expiration of the suspension period.
5.5. If your eligibility and conditions for use no longer meet the service standards stipulated in this agreement, Maxkgo BMS has the right to suspend or terminate the services provided to you as appropriate.
5.6. You have the right to voluntarily close this service.
Article 6 Disclaimer
6.1 Maxkgo BMS does not guarantee the accuracy and completeness of external links set up to provide convenience to users, and Maxkgo BMS shall not be liable for any content on any webpage pointed to by such external links.
6.2. Maxkgo BMS will not bear any responsibility for the loss caused by your improper operation or use of the service in a manner not authorized or recognized by us, as well as the system or Internet network failure of telecom, mobile and other operators, computer failure or virus, information damage or loss, computer system problems or any other irresistible reason, but will try to reduce the loss and impact on users and product use caused thereby.
6.3. During the validity period of this agreement, if Maxkgo BMS fails to provide the agreed services due to laws, regulations, rules, guidelines, notices, policies, and other normative documents issued or changed by relevant national authorities, it shall not be deemed a breach of contract. Maxkgo BMS may change the content of this agreement, suspend or terminate this agreement in advance according to relevant regulations, but will make reasonable efforts to protect your legitimate rights and interests.
Article 7 Law and Dispute Resolution
7.1. The interpretation, validity, and dispute resolution of these Terms of Service shall be governed by the laws of mainland China.
7.2 Maxkgo BMS would like to remind you that in order to ensure the autonomy of the company's business development and adjustment, Maxkgo BMS has the right to modify or interrupt services at any time without notifying you. Maxkgo BMS exercising the right to modify or interrupt services is not responsible to you or any third party. You must agree to these terms before Maxkgo BMS can begin providing services to you.
7.3. If you are a user of Maxkgo BMS related products, programs, and services, the terms of this agreement will remain valid for you until you cancel, uninstall the app, or close your account, but the intellectual property related terms will continue to be valid thereafter.
7.4. If any disputes or controversies arise between you and Maxkgo BMS, they should first be resolved through friendly consultation. If consultation fails, you hereby fully agree to submit the dispute or controversy to the jurisdiction of the people's court where Dongguan Daqianjin Technology Co., Ltd. is located. Maxkgo BMS has the right to interpret and modify the contents of the above terms and conditions.
Article 8 Other
8.1. If the system failure of Maxkgo BMS affects the normal operation of user services, MaxkgO BMS promises to cooperate with relevant units in the first time, handle and repair it in a timely manner.
8.2. This agreement is jointly signed by you and Maxkgo BMS and applies to all your activities at Maxkgo BMS. The content of this agreement includes but is not limited to the main text of the agreement and various rules that have been published or may be published in the future. All terms and rules are an integral part of this agreement and have the same legal effect as the main text of this agreement.
8.3. These terms shall come into effect from the date when the user confirms acceptance of these service terms. Users can contact Maxkgo BMS through relevant departments for their opinions and suggestions on any part of these service terms.
8.4. Regardless of the reason why any provision of this agreement is partially invalid or unenforceable, the remaining provisions shall remain valid and binding on both parties.
The interpretation of the above terms belongs ultimately to Dongguan Daqianjin Technology Co., Ltd.
